Sales at consumers' domiciles or through negotiated contracts

Direct sales to the consumer's domicile or using contracts negotiated away from business premises consist of retail sales and supply of goods and services, performed by a business through the collection of purchase orders at the consumer's domicile or at the premises where the consumer is located, even temporarily, as a result of personal, business, study, entertainment or recreational reasons.
SUBJECT REQUIREMENTS:
- Anti-mafia requirements of all the individuals prescribed by Article 85 of Italian Legislative Decree dated September 6 2011, number 159
- Moral requirements pursuant to Article 71 of Italian Legislative Decree dated March 26 2010, number 59 of all the individuals prescribed by Article 85 of Italian Legislative Decree dated September 6 2011, number 159
- Professional requirements:
- of the owner or the designated supervisor
- of the legal representative or the designated supervisor
for the sale of food products, prescribed by Article 71 of Italian Legislative Decree dated March 26 2010, number 59.
The designated supervisor must be appointed when the activity is not directly exercised by the owner or legal representative.
If the business operates through direct doorstep sales agents, the agent's activity is subject to the mandatory possession of an identification card, issued directly by the business.
The badge must be numbered and updated annually, must contain the personal details and the photograph of the appointed sales agent, a printed indication of the location and the products covered by the business activity, as well as the name of the manager of the business, and the latter's signature, and must be visibly displayed during sales operations.
The badge is also compulsory for the sole proprietor who operates individually, without the assistance of agents.
The start of the activity is subject to a certified notification of business opening (SCIA).
SCIA documentation is prescribed by SECTION I - COMMERCE AND SIMILAR ACTIVITIES - POINT 1 - COMMERCE ON PRIVATE AREAS Activity number 1.11.5 of Table A annexed to Italian Legislative Decree dated November 25 2016, number 222.
The appointment of sales representatives at the same time as the start of the activity is subject to notification.
The manager of the business submits the register of sales representatives (and its successive modifications) to SUAP, which forwards it to the public security authority of the district in which the business is established.

Inspections are conducted by:
- the Municipality
- the public health Authorities
- the Police Headquarters, which monitors the sales agents.
