Retail sales can also be performed using vending machines.
The start of a vending machine business is subject to SCIA.
The installation of food vending machines with the start of the business is subject to communication.
Any further installation/de-installation of vending machines distributing food products is subject to annual notification (on or before January 31 of each year).
Sales using vending machines in dedicated premises which are exclusively used for this purpose is considered equivalent to the opening of a neighbourhood retail shop.
Sales using vending machines implemented by pharmacies must exclusively involve the specialized items listed in the specific table in annex A to Regional Law dated December 5 2005 number 29, with the exception of medicines, and it must be exclusively implemented inside the pharmacy or in its immediate vicinity.
SUBJECT REQUIREMENTS:
- Anti-mafia requirements of all the individuals prescribed by Article 85 of Italian Legislative Decree dated September 6 2011, number 159
- Moral requirements pursuant to Article 71 of Italian Legislative Decree dated March 26 2010, number 59 of all the individuals prescribed by Article 85 of Italian Legislative Decree dated September 6 2011, number 159
- Professional requirements:
- of the owner or the designated supervisor
- of the legal representative or the designated supervisor
for the sale of food products, prescribed by Article 71 of Italian Legislative Decree dated March 26 2010, number 59.
The designated supervisor must be appointed when the activity is not directly exercised by the owner or legal representative.
OBJECT REQUIREMENTS:
Installation of vending machines in public areas is subject to the occupation of public land.
The start of the activity is subject to a certified notification of business opening (SCIA).
SCIA documentation is prescribed by SECTION I - COMMERCE AND SIMILAR ACTIVITIES - POINT 1 - COMMERCE ON PRIVATE AREAS Activity number 1.11.2 of table A annexed to Italian Legislative Decree dated November 25 2016, number 222.
The installation of food vending machines at the start-up of the business is subject to notification.
