Sales at in-house outlets - Filed descriptive card
Factory outlet

Public administrations, businesses, private clubs, consumer cooperatives and their consortia, voluntary associations, NPOs, non-profit associations, and cooperatives may perform retail sales for the benefit of their employees, members, and family members respectively.

Sales made inside municipal sports facilities (for example, the sale of goggles and swimming suits in a swimming pool) are also considered sales at in-house outlets. 

Starting from 23 february 2023, the activation of sales at in-house outlets is not subject to any communication to the SUAP, without prejudice to compliance with building and urban planning regulations, including those for protection against acoustic impact , sanitation, and provisions relating to fire prevention and those relating to public safety of the premises, as well as all the sector regulations governing the activity carried out. 

SUBJECT REQUIREMENTS:

 

  1. Anti-mafia requirements of all the individuals prescribed by Article 85 of Italian Legislative Decree dated September 6 2011, number 159
  2. Moral requirements pursuant to Article 71 of Italian Legislative Decree dated March 26 2010, number 59 of all the individuals prescribed by Article 85 of Italian Legislative Decree dated September 6 2011, number 159
  3. Professional requirements:
  • of the owner or the designated supervisor
  • of the legal representative or the designated supervisor

for the sale of food products, prescribed by Article 71 of Italian Legislative Decree dated March 26 2010, number 59.

 

The designated supervisor must be appointed when the activity is not directly exercised by the owner or legal representative.

 

 

OBJECT REQUIREMENTS:

 

Premises not open to the public must not exceed 250 square metres in area and have no direct access from any public thoroughfare.

The requirement of having no direct access from any public thoroughfare is only required for premises in operation after December 31 1998.

The Regional Law 17 February 2023, n. 5 has eliminated the certified notification of business opening (SCIA),  prescribed by SECTION I - COMMERCE AND SIMILAR ACTIVITIES - POINT 1 - COMMERCE ON PRIVATE AREAS Activity number 1.11.1 of table A annexed to Italian Legislative Decree dated November 25 2016, number 222

Inspections are conducted by:

  • the Municipality
  • the public health Authorities in the case of food sales.
  • the Fire Brigade
