Sale of agricultural products
Farm, cultivation, forestry, animal husbandry, aquaculture, fishing, agricultural products, agricultural entrepreneur, agricultural producer, sale, wine, ATECO 01
An agricultural entrepreneur performs land cultivation, or forestry, or animal husbandry, and related activities.
Agricultural entrepreneurs, who are registered in the special section of the company register, are permitted to sell at retail the products predominantly coming from the farm and the products derived from it.
Direct sales activities are possible:
- on open-air areas within the farm. There are no obligations towards SUAP for this type of sale, but only towards the public health Authority
- on premises open to the public
- by electronic commerce
- employing automatic distribution
- in public areas with a fixed stand
- in public areas in itinerant form.
The agricultural entrepreneur is permitted to:
- sell agricultural products, including manipulated or processed products, ready for consumption, even in the itinerant form in public or private areas
- facilitate the immediate consumption of the products for sale, using the premises and farm furnishings, with the exclusion of assisted serving.
SUBJECT REQUIREMENTS:
Moral requirements pursuant to Article 4, subsection 6 of Italian Legislative Decree number 228/2001, for the following individuals:
- the owner of the sole proprietorship
- for partnership companies, all the partners
- for other juridical persons, all the directors
Anti-mafia requirements of all the individuals specified in Article 85 of Italian Legislative Decree dated September 6 2011, number 159
Registration in the special section of the Register of Companies pursuant to Article 2188 and subsequent articles of the Italian Civil Code. Registration in the Register of Companies is a prerequisite for retail sales.
OBJECT REQUIREMENTS:
The direct sale of agricultural products performed on open-air areas within the farm is not subject to obligations towards SUAP, but only towards the public health Authority.
The start of the sale and/or serving activity is subject to notification.
The notification is prescribed by SECTION I - COMMERCE AND SIMILAR ACTIVITIES - POINT 1 - Activity number 1.9 of table A annexed to Italian Legislative Decree dated November 25 2016, number 222.

Inspections are conducted by:
- the Municipality
- the public health Authorities.
